![]() --What Do Process Servers Do?-- A legal process server delivers (or serves) legal documents like, writs, summons, subpoenas, complaints and other court documents to a defendant or an individual involved in a court case. The process server must serve the documents in accordance with the legislation in the area of service. This may mean handing the documents to the defendant personally or sub-serving to someone in the same household or business. Once the documents are delivered, the process serving agent must provide proof that the papers were served. This is done through a document call an Affidavit of Service, also called a Proof of Service, which must be notarized and given to the party who requested service. Some states require a process server license, and in some states they are required to post a surety bond. Other that can serve are Private Investigators --Selecting a Process Server-- When choosing a process server to handle your service of process needs, there are various criteria you can use to help you in your choice. First, you should determine if your state requires that process servers be licensed. If so, be sure to only choose licensed professional process servers. Be sure that the process server you choose is educated as to the laws of your jurisdiction. In New York State you cannot serve on Sundays . Some places do not allow papers to be served on a person traveling to court. It is also very important to note, that papers cannot be served by someone who is involved in the case or legal proceeding. -- Hiring a legal process server is an important step in proceeding with a court case |
